Institute based in London lost my answer sheet can I take any action

Sir/madam I have done Nebosh IGC course which is in London and accepted all over the world it is very tough to get pass, I don't it in chennai and got pass in two subjects and for last paper also I wrote very good on March 31st 2016 they told result will be published on June 10th but they lost my paper and informing about this on June 1st 2016 and asking me to write it again on Aug 4th I have totally wasting my time all most 6 months because of them I also tried to contact them they are not providing me good solution, can you suggest me some idea can we apply case against them from INDIA ?

Did you apply for the results of your examination in writing to the institute and did you get the reply in writing?
Did you verify the veracity of the reply received through email informing that the examination papers have been lost by them.?
If the extermination papers have been lost it can be confirmed that you have not written the examination online but have written them physically on white papers, the same was forwarded through an agent or franchise here in India.
Did you contact such agent or franchisee about this in writing and have you got their reply in writing?
If yes for above, you may issue legal notice to this agent and endorse a copy to the institute demanding relief and alternate remedy.
If you dont get a response or if their reply is not satisfactory, you may drag both of them to the consumer forum seeking relief and also compensation for the mental agony you suffered.

Have all communications ,with department in writing, and you can get remedy by escalating the same to High court., the department had to give reasons for asking to take re exam, and it should be satisfactory to the court and concerned party and any breach of terms will invite wrath from court.
