Informal agreement with the builder now he cheated

I wanted a certain builder to construct my house, but the builder tried to cheat me and now I have a house that's not completely constructed. Now we have reached an agreement and have settled for a certain amount. I have an informal agreement on a piece of paper, signed by both parties and two witnesses. Do I need to get a formal agreement on a stamp paper for this or will this informal agreement suffice?

Hi. My advice to you is that you should get a settlement deed drafted and signed so that incase the builder fails to fulfill the promise in future you will be in a position to take a necessary action. For further clarifications please get in touch.

Hi, in my opinion you should go for formal agreement on a stamp paper as he has cheated you earlier also and informal agreement will not be suffice as such.

As per stamp act every agreement must be properly stamped otherwise that documents shall not be admitted as evidence. Since you may claim damages on the basis of settlement agreement and it must be properly stamped for enforcing the terms mentioned in that agreement.

Hi, it is better if you get the agreement done on the formal paper. You will have the legal value of that. there will be entry in the register of notary also. the agreement of white paper and has no value and you have to put more efforts to prove that.
