How to file case against mobile insurance company

i got my Mobile insured from the Mobile insurance Company... . They took it (my Broken Mobile) away and promised to return within 20-25 days after Repairing it .But Returned me Unrepaired After 3 months . They ask me to re-submit the Mobile for Repair...but i Refused it because they Harassed me which I don't have the words to explain... . Then they called me after a month and said that they will give me the money for the Repair but I have provide them the Estimate From Authorized Service Centre... which I have already given them but they are dogging me from last 2 months .... . i got it repaired on my own ... . Still they are dogging me ... . I want to sue them ...?? Suggest me the procedure Please

You can file a case againt this insurance company with all valid necessary documents which are needed as an evidence and for the admission of the case .ghis case will be file in consumer court as this is the consumer matter .
