How to file case against builder for unfair practices

02-Jun-2023 (In Consumer Court Law)
I am from Hyderabad, builder sold us a constructed house in 2013 by saying it has all legal permissions, we got home loan, registration done and paid all money to him 1.Now we understood that it's not an HMDA approved layout 2.He not done land conversation from agriculture to non agriculture 3.He created a document stating that it is approved Panchayat layout in 1976 4.Infact he collected service tax from us but it's not payed to Government 5. He even not have 10% open land, as per hmda it should be Now we applied to hmda in LRS scheme, around 2.5 lakhs need to pay individually, there are 130 houses totally How we get justice, where and how to file case on Builder, is there any reference judgement for such cases, do we get justice? There are many like this in city

It seems you purchased a Gram Panchayat layout. What the Builder had promised you whether GP layout or HMDA? Is there any proof that he promised HMDA. If there is proof, you can file cheating case against him. You can also file consumer case for damages. Non conversion of Agrl land to non Agrl is also a big problem. You have to convert atleast now by paying huge penalty. You can contact me through Lawroto.

Now coming to regularisation, there is no other way except to do LRS by paying 2.5 lakhs. You can recover this amount from the Builder later.
