How to file a case against builder for delay in possession of flat

Hi, i want to file a case against builder for compensation for delay in possession? my query is that limitation period started from 27/03/2015 when we got allotmnt letter and now the limitation period is over i.e. on 27/03/2017 can i file a case alongwith an application for condonation of delay....?? plz help me...??

Yes u can file with an application to condone the delay with bonafide

Consumer courts are very liberal in condonation

hello
you need not file condonation of delay application as cause of action have arisen on 27.03.2017. you can file simple complaint in consumer court and within 6 months you will be able to get builder to justice.

yes, You can file Complaint in Local Consumer Court. For Delay in Possession, Unfair trade practice.
You can claim For Compensation, Legal Charges, Interest.

Condonation of Delay not take place because Limitation Period 27th march 2015 and ended on 27th March 2017, in between have you sent letter to Builder, Any correspondence done with builder, so you can file complaint against him.

yes, your limitation start from the date of builder agreeing into handover the possession. if any correspondence subsequent to the possession date then your limitation start from that date. my advise would be to go head and file appropriate case against the builder
