How can I sue Appsdaily a Mobile insurance Company

I have submitted my S7 Edge to AppsDaily for repairing after it’s screen got cracked as i purchased AppsDaily Insurance for the phone. I submitted my phone (by paying Rs 3000) in November 2016 at their center. I haven’t received my phone yet (in April 2017). In March, 2017 i received a call saying that we can’t repair your phone so it has to be replaced with a new one but for this you have to pay Rs 14000. I paid this amount. But here i am, without my phone :( And now, there is no response on the Customer Care and my mails are not even getting delivered to their customer care email ids. How can i sue them, now ? Or what should be the next steps ? Thanks for any legal advice.

You will be required to file a complaint under consumer protection act under section 12 stating all the facts in the concerned conplaint and you can also ask for the amount you paid and for compensation due to harassment you seffered...

Hi dear. File a consumer complaint to your district consumer forum for deficiency of service against the mobile company. Also you can file civil suit for recovery of your amount. Take an early action to get an effective result.

Thank you for your query. It seems like consumer court matter. If you have proof of payment and receipt and any kind of receipt or documents that you gave AppsDaily to repair your mobile phone you can now proceed to file a case against them in Consumer court.

Do you have proper receipt for payments and deposition of Mobile Handset? If yes, than the way ahead is very easy.

First, send them a legal notice asking them to repair your mobile within 15 days or return the amount paid by you with interest along with mobile handset in original position. If they comply with notice than Congratulations. If not, than you will have to move to the concerned Consumer Forum for redressal of your problem.
