How can I file a case against additional charges levied on me?

Hi, i bought a flat from paras season and now when I am selling the flat they have introduced a NOC issuance charge of Rs 200 per square feet. No such charge existed when I sold my previous paras season flat. Can we do something legally to stop this extortion?

Hello,
You haven't provided any details of the NOC for which builder is trying to extort money. If it is illegal or non justifiable then you can approach to the regulatory forums of the builders. Apart from that you can initiate against him criminal as well as civil proceedings besides filing a complaint under Consumer Protection Act before appropriate forum.

if the clause regarding premium on sale is entered in the agreement / or sale deed and you signed the same then you will have to pay the charges.

if the condition is not written in the sale deed or agreement then they cannot ask for the NOC charges.

however in both cases you can challenge their conduct/demand before the consumer court / appropriate authority under RERA Act 2016.

Yes you can file complaint against the builder for levied unnecessary charges for NOC on selling your flat, if there is no terms and conditions in your agreement regarding your resale of flat.You can also lodge a complaint to police for builder's furad.
