high mobile bill by deaf person as ISD activation by Aircel chennai

without security deposit and customer authentication ISD activated and unfortunately some unknown number has got dialed due to keypad unlocked during bedtime, bill received 10000+ higher than credit limit 2000, the person iusing the number is an elderly person with little deaf and is using a basic model, Now service provider asking to pay the bill amount, will this be justified? Mobile company: Aircel Chennai

Hi,

Did you go through the terms and conditions given in the customer application form (CAF). If the company has to get consent before activating the service, then certainly this is deficiency on the part of the service provider and if not then you are liable to pay as you used the service (knowingly or unknowingly) but you can raise a dispute with the provider for the bill exceeding Rs.2000 as that is the credit limit set for you by the provider themselves.

Get the itemised bill from your service provider for that mobile number. Then send a stating the events and your grievances and to waive unauthorised bill stating the error on service provider side. If your genuine request is not heard properly than It looks like your service provider is trying to extract money from you. Generally when a credit limit is fixed the outgoing call will be barred on reaching the credit limit. It is unrealistic to believe that even when a wrong ISD Number is dialed it went on for several hour to accumulate such a hefty bill amount.



Get the policy document of your service provider either by downloading or by some other means and check for this clause. If you have both the itemised bill and the policy document of your service provider with the credit limit clause then pay the billed amount and go-head to file a consumer compliant in an appropriate consumer forum and claim X10 compensation on billed amount for the deficiency of service + damages for mental agony. For this you need to justify with proper documentary evidence.
