Flat was to delivered in 2013 but now giving in 2015 how to get refund

I bought a flat in 2012. He was supposed to give the possession of the flat in 2013. Now they are delivering the same in 2015. I dont want the flat any more and want refund of my money paid?
Since time is the essence of such contracts, you are entitled to claim your money back on account of default by the builder. You may claim a refund by filing a civil suit in local district court or by filing a consumer complaint before appropriate consumer forum. However I will need to go through your contract before giving you a certain advice.

you have filed the consumer complaint case against the builder and you have right to refund the money you have paid. You have also claim the damgages and interest from the builder. The consumer court has also grant the litigation charges to you.
