FDR status in state commission

22-Aug-2023 (In Consumer Court Law)
District forum has given decision in my favor . Appeal was made against the decision. FDR was submitted in State commission by them. Now the appeal has been dismissed. I would request you to let me know the status of that FDR.

To satisfactorily answer you query, I would require the following details:

1. Does the judgment in the State Commission mention anything about the release of the FDR?
2. Has the State Commission judgment been challenged in revision before the Hon'ble NCDRC?
3. Has caveat been filed by you before the Hon'ble NCDRC?
4. Has execution in the matter been filed by you before the District Forum?

The answers to these questions would be imperative for further assistance.

Hello
I have gone through your query, first of all if the order of appellate court is in your favour you can ask for the FDR to be released in your favour.
The status would be that the FDR money would have increased as per the rate of interest and will be given to you through the registry of the court
Thanks

You can move an application before the State Commission seeking leave of the court to withdraw the FDR deposited. Do check if a revision petition has been preferred by the Appellants before the National Commission.

Your lawyer should have asked the court for the release of the same in your favour while the order was reserved. Now if your money hasn't been paid u can file an application before the district forum for execution of the order
After that u can file an application before the state forum for release of the FDR
The process has to be done fast so the limitation doesn't expire and the opposite party doesn't move an application before the state forum for release of money in your favour

hello
You will have to file an Application for the release of the award amount.
If its the total amount then it can be released through this Application.
Else you will have to file execution proceedings.
please feel free to contact us we shall be happy to help you.
