FALSE SUBMISSION IN WRITTEN STATEMENT BY BANK

A complainant case is going on in National Consumer Disputes Redressal Commission, New Delhi. In written statement of a pvt bank, it is submitted that bank did not sell insurance policy with mortgage loan when it is clearly mentioned in website of bank that same insurance policy is being offered by bank to home loan customers. The case is on final stage of arguments, my question is court is not a place for fun, can a criminal be filed against bank? If yes then application in NCDRC is enough in this regard or case will be file in civil court or high court?

Hi, in case any false statement is submitted by one party, the other party is at liberty to take suitable legal action under section 340 of Cr PC and other provisions of law. it is duty of all the parties to case to come clean before the courts.

Yes, You may file a criminal case. The case can filed as a complaint before the Commission as well as the Local Magistrate's Court for perjury, fraud and contempt. You may draft and file the said complaint along with the copy of the written statement and the Website Copy too.

Yes you can file an application for instituting a criminal case against bank for misleading the court.
If you have sufficient evidences then go ahead.
I need to examine the written statement and evidence filed by the bank.
