Don't know what to mention in Disputes, Laws & jurisdiction on my site

19-Jan-2023 (In Consumer Court Law)
I am a drop shipper from India having a Shopify store and create my own designs which are been printed on products that are fulfilled by Printful(print on demand company) in U.S.A,Europe and Internationally. I have created a TERMS OF SERVICE Policy similar to that of Printful(my backend fulfillment company located in U.S.A) with minor changes but I am unaware of point 16 in this Printful's TERMS OF SERVICE Policy here:- https://www.printful.com/policies/terms-of-service So what should I mention:- 1) In which court the dispute or claims will be settled? 2) And what should I mention in cost of arbitration? Thanks for the help Saurabh Verma

Saurabh, Term 16 of the policy talks about the arbitration clause. In situations where a dispute may arise people move to court and file cases. However, nowadays a more hassle-free, less time consuming and pocket-friendly mechanism of arbitration is invoked. A person who is a third party is designated to adjudicate the matter instead of the court and the decision of the arbitrator is to be respected by all. In cases where the contract is between two persons who do not live in the same country or state have an option of choosing as to where the arbitration will take place and what laws will apply to the agreement. You are free to choose these aspects mutually. Now in your case, if you are the service provider then you should include India and also the state where it would be convenient for you to add as the seat/place of arbitration and the applicable law to be that of India. With regard to the cost of arbitration, you can visit this link http://www.icaindia.co.in/htm/clouse.htm for coming up with an amount for the cost of Arbitration.
