District consumer forum dismissed case on default of non-apperance
28-Jun-2023 (In Consumer Court Law)
Sir/Mam I filed a case in the district consumer forum of karnal in january 2017. I believe my case was strong enough and i also appeared in the forum each time they gave me a date without fail. Due to some uncertain reasons, i failed to appear in the forum on the last recent date given to me and now i found that my case is dismissed due to non appearence in the forum. I strongly believed that consumer forum would not let me down but to my surprise i found that consumer forums are not much consumer friendly. My case is dismissed without any information or notice. I am feeling helpless, what should i do now ?
If your case has been dismissed on the ground of non-appearance of the complainant on one date of hearing, in that case you can move an application before the same court within 30 days of the order of dismissal for restoration of your complaint, mentioning the facts and reason of your absence. If court doesn't allow your application then you can move to the State Consumer Forum against the said orders.
File an application for restoration of your complaint along with certified copy of said order, stating reasons for your non appearance. There are lots of supreme court ruling where liberal view be taken on such cases,so don't worry it will be set aside and case will be again proceeds from previous proceedings.
You can file an appeal in the State Commission within 30 days of receiving the order of the District Forum. If you have already crossed 30 days you may file an application for condonation of delay along with your appeal.
