Delayed Possession for my Plot and now Developer is not responding

I booked my Plot through Ansal Housing in Agra in Year Nov 2009 Complete payment has been done but they are not giving possession. Lastly I agreed that give me my money based upon the current per sq ft area rate in Agra but still they are not responding. I need money urgently but not getting any kind of response from their end.

You should immediately give a formal notice and file a consumer case immediately as more than 6 years have lapsed .though it is a continuing cause of action, but sometimes courts put the question of delay in approaching the consumer court therefore file yhe case at thr earliest.

under the new real estate act there are a lot of provisions for the buyers.The Act provides for time bound resolution of complaints and disputes by the RERAs and the real estate appellate tribunals. The Act also provides for refund of amounts paid by consumers (along with interest and compensation) for promoter's failure to give possession of the apartment in accordance with the agreement for sale, or any breach of such agreement. Engage a counsel who may then send a legal notice to the builders. Dont worry your rights are secured.

You need to file consumer case based on the valuation of the property and claim compensation from the consumer forum. you need to file your agreement and receipt. generally the builder buyer agreement gives period of 36 months for possession. recently consumer court have started giving compensation @ 18% PA.

you are advise to file a criminal complaint for cheating and breach of trust against the official of Ansal Housing before the Police Station and if not lodged file a complaint case before the CJM, Agra and also file a consumer complaint case against them before the proper forum of the consumer court. please take steps immediately. also also issue a legal notice through lawyer before litigation.
