Delayed possession by builder and no progress made since launch

My friend has booked an apartment at pre-launch and has paid 30% of total cost. The builder has not started construction even after 2.5 years. 4 months ago she cancelled the booking but builder has not paid back the amount. what are the options for her? Should she file a police complaint. Is going to consumer court better option?
