Delayed possession being asked to pay tax and penalty

 I bought a flat inDevlali( Nashik )from homedevelopers project and got agreement registered at nashik rd in feb 13. The possession was delayed beyond 2 years. Finally i got possession in Nov 15 with lots of deficiencies which i gave in written. Some haven't been rectified and now builder is asking for Service Tax and VAT on registration amount of 31.5 lacs with delayed interest payment ranging in1.5-2 lakhs. Question is 1.why SERVICE Tax and VAT at this stage? 2.why interest on the same? 3.I want to go to consumer court for deficiencies 4.I am ready to pay service tax if any to govt but not to builder 5.Is sale deed possible without Service Tax and VAT? Being in army i cannot go to nashik in near future. Please advise.

yes sure we can sue the builder in consumer court, the jurisdiction depends where the builder resides or has his place of business, or where cause of action arises. builders threaten with interest charges, however it is not mandatory. Court can grant relief

yes you are not required to pay service tax and VAT you have purchase the property after the construction of the building. as far the registration amount is concern under the law the maximum registration fees is Rs. 30,000/-
