Delayed compensation by builder Emami realty

My sister has purchased a flat from EMAMI REALTY , project named as Emami City located at kolkata. The project was delayed by 2 year and the handover process is starting now. Though there were penalty clause in the agreement, but currently when we are asking for the compensation , the entire Emami management is silent not responding to the mails even. As RERA act is not there in West Bengal the builder lobby is exploiting the customers now.
Our concerns is should we take the handover and then file a case or we take action before that. As my parents are old and we need to shift them , we are worried that if we file a case before taking handover we won’t even get the flat. Can you please suggest as what we should do?
As per your query in law rato as there is a delay you can file a case in consumer forum and ask for compensation for the delay and mental harrassment for your parents as they are old.valuation of the flat needs to be considered.
