You are entitled to get your money back with interest. Please write to the company to return your money with 18% interest compoundable quarterly. Send the letter by speed post and keep proof of dispatch. Further action will depend upon their reply. If they do not accede to your request you can file a case in Consumer Forum for recovery of your money and cost of litigation. You should look at the documents signed between you and unitech. Ideally for a consumer, in case you are asking for possession of deficiency in services, then ideally make petition before district consumer court, though jurisdiction of district consumer courts is 20 lakhs, if your relief is valued over 20 lakhs, you need to approach State commision which practically may not be near to the place you reside. Another remedy is to approach civil courts, for specific performance of contract signed between you and builder. In addition it is likely that builder buyer agreement has arbitration clause, and one may enforce arbitration for your rights under the terms of builder buyer agreement and claim compensation if provided under contract.
