Delay in flat possession by builder what can I do.

Dear Sir, I have purchased a flat in Goa, in which agreement stated that the possession will be given within 18 months. But due to financial crisis i couldnt manange home loan and rent, so I started staying in my new flat for which NOC was not given. The builder stated that the building will be completed within few months. Now its almost 1.5 yrs and he is not yet completing the building. I have planned to shift back to rented house now. Plz help me what next to be done. As if I go to rented house, again both (Loan and rent) will be difficult to for me to pay.

Your agreement with the builder will be required to be examined to enable us to advise you better. Nevertheless in the facts submitted you have a good case for deficiency of service by the builder. Trust that some solution could be arrived at in negotiations with the builder failing which u might need to go to the Consumer courts.
