Delay in execution of construction of flats
29-Aug-2023 (In Consumer Court Law)
I had booked flat which was under construction in 2013 with prestigious company and paid paid 1 lakh initial advance. Subsequently over a period time and till now paid coraround 65 % of payment to the total cost (Rs.15 laks out of 22 Lakshs.). As per agreement, flat to be handed over to us in Aug 2015. Construction progress is very slow added to that, they are demanding remaining installment amount to paid . Now company is saying the project will be further delayed by another 2 years. Any legal action can be taken from our end? Pl. advice.

This is very common with the builders. It is surprising that it is a prestigious company, continue paying u r instalment, but simultaneously send a legal notice, provided, u have entered into an agreement and if there is time schedule within which the bldr has to complete the project, if there is a delay and the agreement mentions any penalty clause u can enforce it, failing wherein u can file a case deficiency of services for unfair trade practices, mental agony and compenstation.

You can file a consumer complaint and recover the amounts deposited along with some interest provided you have all the documents from the Builder. Also sometimes we can take resort to some other remedy which will give you a much expeditious remedy and you will get back the amounts in no time. Dear Sir/Madam, Yes, you have to take legal action in this regard against the said builder in pursuance of the agreement before the District Consumer Forum, before going to file petition you have to issue a legal notice for the same through advocate against them.
