Customer wants the benefit of mistake made while calculating road tax

07-Oct-2023 (In Consumer Court Law)
Hi, I am sales consultant in Maruti Showroom at Delhi. In the month of April I sold a car to Noida resident customer. I took wrong road tax of Noida by mistake , customer knew that I am taking wrong rto amount but he didn't tell me. After 3 or 4days of the car delivery i git a msg that I took 8% instead of 10% I talked with customer about the mistake and demand rest 2% but he refused and told me that he will go in court to not pay the rest 2%. He is making pressure on us to release the RC of that car. My company is saying that they will debit the amount to me and release the RC to him but I don't want this. Why customer always in comfort zone? Customer knew about the wrong rto amount. Plz suggest me the right way. Regards

Tax is a statutory obligation which customer can't refuse.
Ask ur company to issue a legal notice to the customer.
In the event, customer goes to court, his case shall not be maintainable.
He can't claim any deficiency in service on account of an inadvertence in calculation.

Hi...First of all send an notice to the customer stating the details of bill mentioning about details of amount about the rate of taxes applied as on date and further ask for remaining amount due from him ; how do you know that your customer was knowing even then he escape himself and made short payment ? . Is there anything on record to show that 10% is to be levied and acceptance from your end that full and final payment is received .If on record we are not at fault then no need to entertain him . Let me know the detail about my queries then we can decide further line of action

Hi, you need to recover the amount from the client and also convince your owner/boss. But, From your query it is not possible to know the complete facts of the case and in this situation it is difficult to clarify and advise you correctly. You are suggested to provide the complete facts.
Thanks and regards
