Consumer rights in respect of house construction

Sir, I recently tried to renovate my old small flat through a local contractor, in Feb-19. I detailed him about kitchen / bathroom interior work, other misc work to be done and asked him for cost estimates before actual start of the work. However, the contractor first broke the entire kitchen and then asked for Rs.1 lakh. When I insisted for total estimates, he orally quoted Rs.2-2.15 lakhs + taxes. I paid Rs.1 lakh by cheque, then after a week I paid Rs. 1 lakhs by cheque and after few days paid Rs.50,000/- by Cheque. The work was moving very slowly. He started most of the work, did half work and suddenly demanded again for Rs.1 lakh. Shocked, but I asked him to compete the entire work first and then to give proper bill. However, he insisted for payment of full amount and stopped the work. Now I flat is not in usable condition, I cannot rent it now and one month over, no progress The contractor is trying to extract some more money. Can I take any legal action against him? Pl advice

1. Had you with your contractor any type of Agreement or contract in writing.
2,is there any classes with you and between contractor.
3, Is it They stopped at present work.
4, If you have any type of documents regarding this you may file definitely before consumer forum,as deficiency in service.

1. It is cheating and forgery by the local contractor. I suggest you to issue legal notice to him to repay your money or get the work completed.
2. Unless, you take it legally, i do not think the work would be completed.
