Sir

Please once you confirm that is the doctor visited and checked the patient regularly. They will maintain the day report book for each and every patient. Please check. In case if the duty doctor is absent then it will be the best ground to claim compensation.

Apart from that please confirm that is the doctors advised you to take your father to other hospital for treatment or asked you to take care of him in this hospital even though the doctor having the sufficient knowledge that from the available equipments, such treatment for your father cannot be provided.

If there is failure on the part of the doctors. then it will shows the negligence on the part of the doctor.

When you have such proof, then you proceed by filing the complaint in Consumer case.

Yes you can claim for the compensation with valid proofs and documents which caused death for your father. You can sue against hospital for its negligence and reckless act and can prove your case with an assistance of any good lawyer . As I said there should be supporting documents to prove the guilt of the doctors. You can file the complaint at Consumer Forum.
