Company has included violative provisions against costumers,what to do

Country club membership agreement contains the terms 1. Membership fee is not refundable in any circumstances but in one of case court has said that the same term is encroaching the rights of consumers. (circumstances can be anything) 2.All disputes should be raised to the court situated at the Hyderabad which also encroaching the right to make complaint at district consumer court (where cause of action occurs) The agreement violates the right to return goods that have not been used,within a specified time for a refund if one does not like the product he has purchased. So, How company can insert such clauses violating the consumer rights and consumer protection laws An agreement not enforceable by law is said to be void according to contract act. How we cant cancel such agreement?

You should not sign on such an agreement if you do not think it is reasonable, no one is forcing you. Also, if there is any problem regarding the services of the opposite party then you can file a complaint in the jurisdictional consumer forum under section 2 of the CPA.
