Club Mahindra-Paid holidays blocked- M'ship cancellation-refund Issue

24-Nov-2023 (In Consumer Court Law)
Membership Date - Dec 2008. 25 yrs. membership charges paid - Around 1.4x lac. Dispute - Club Mahindra (CM) blocked my paid holidays. Reason given by CM - Pending annual subscription fees (ASF). My argument-CM has not rights to block the paid holidays. Free to block the unpaid holidays. CM not ready to accept this. I asked to cancel the membership with refund on pro-rata basis, approx. 90 k. As per their calculation there is '0' amount to be refunded. They want me to give a written consent on zero refund acceptance for processing the cancellation. CM is not cancelling the membership and are adding debits to my account against ASF and in parallel the holidays are getting lapsed due to a block placed for availing. In a nutshell, CM is adding holidays to the account only to get them lapsed due to accumulation criteria (21 days) and the corresponding ASF still reflects as a debit, resorting to extreme unfair trade practices. Need help for cancellation/refund. Regards - Shailesh Shah
