Clarification on procedure to file case for loosing parcel in transit
13-Jul-2023 (In Consumer Court Law)
Hello Sir, I sent a parcel on "Oct 2017" through a Courier to Mumbai from Ranchi, but the parcel got missing on its way towards Mumbai. After putting repetitive pressure on the Owner of the courier he promised me that he will pay back the Parcel amount along with the Courier charges through the Company's Head Office. And, for the same purpose he requested me to provide the original purchase "cash-memo" receipt of the parcel to prepare a "Claim" document to send it to head office, for payment of Claim amount. I provided him all documents and he prepared the "Claim Documents" in front of me, I also took a "PhotoCopy" of all the documents prepared, along with the Signature of Owner upon it to keep with me. But today on 13/07/2018, After more then 8 months passed, he has not paid me the Claim Amount and makes several excuses when I try to pressurize him. What sort of things can I do Legally, to recover my loss. what are my Legal rights as a consumer under this situation. Kindly Help..
Thanks for contacting me. I would like to inform you that the loss of parcel in transit amounts to serious deficiency in service. As you are a bonafide customer of the courier company so you have to approach the consumer forum and lodge the complaint case for deficiency in service against courier company. Also you need to state the amount for compensation for the mental agony, direct loss etc occured.
Yes u have full right to file a case against them in consumer court being a consumer..
First of all send them a notice either by urself or through a lawyer send a legal notice threatening them for filing case against them and give ultimatum of 15 Days to comply then aftr that u can file a consumer case ...for help and guidance in drafting or anything else can contact me through this legal site...gudluck

Well, as you explained your matter comes under the purview of deficiency in service to the consumer for which you have paid him.
Perhaps, you should have to knock the door of consumer Court. This is the perfect case for consumer Court.

You can get several types of reliefs in such case. You may punish me for there act, get compensation or you can get return of the documents they missed.
