Cheated By Medical Equipments Manufacturing Company By INR 136800

Dear Sir, in November 2018 I booked two medical equipments from a Chandigarh based company for laboratory use by paying 50% in advance through NEFT. Till date I have received only one unit worth 45000 still not installed and now they agreed to refund the rest amount but avoid in some or other way everyday. I want to file a fraud case as well as consumer forum case. I approached consumer forum online but how can they say this is not a consumer Court case?
In my opinion you can serve a legal notice and then file a case before the Consumer Despites Redressal Forum .
Otherwise you can file money recovery suit before the civil court.
