Case filed against Karvy but advocate for builder did not appear court

Filed a case against Karvy and their client (builder). Current status is “Version”. Advocate for only Karvy came to court during previous hearing and advocate for builder (Karvy client) not appreared. What will happen in next stage? What happens if court decides no violation of agreement terms by Karvy but their client violated terms of agreement and no presence of advocate from Karvy client.

The fact that the builder advocate has not appeared in consumer court proceedings will not have any impact on the order passed. The court will pass ex-party order as far as builder is concerned. You can share the copy of order with builder and in case of non compliance of order by builder, you can go ahead with execution of order.

Since you have purchased the property from the builder through there exists principal-agent relationship and both are liable for any deficiency in service and further even after 45 days if they do not comply with version then the builder will be made exparte and the court will proceed with the case.

Even if the builder does not appear the case will be decided on merits, depending on the evidence lead by you and whatever evidence is submitted by Karvy. If the court were to find that there is no violation, then you can prefer an appeal against the order before the State Commission / National Forum.
