Case Against Gruha Kalyan is it mandatory to file FIR

I booked a flat in Bangalore through a builder Gruha Kalyan by paying 4L. MOU commencement date is 22 May 2016. As per the MOU is for 24 months + 6 M grace period. Right now I moved to Kolkata. Now their office is no longer functional, their website is closed their helpline number switched off, emails are non functional, staff not to be found anywhere. What should I do to get my 4L back. Can I file a case in CC? I am now residing in Kolkata, do I need to be present for each hearing (I do not have anybody in Bangalore) because I wont be able to do that. Is it mandatory to file a FIR?
You will be only filing complaint and Police can only file an FIR based on your complaint. Though It is to mandatory for you to file a complaint it involves no cost to you, I can give you the address of Police and you can send a complaint by registered post. now why complaint is necessary ? It is because the builder company has shut its office and you do not know where to serve notice to them. And without their address against them you cannot file any type of civil case either.

As per my knowledge the Representative of the said company were in custody under inquiry. There are several builder who taken money from innocent customer and ran away
If possible please lodge a complaint against them and also file a consumer case in recovery of your money. In criminal case your presence is require. But in consumer case your presence is not require. . You should FIR and the said company was indulged some fraudulent activities. So many person already filed the complaint.
