Case against builder pending can I still get possession of flat

During the pendency of a consumer court case for refund against a builder, can I still take possession of the flat if it's offered. And if yes then in that case can I request court to allow me for a delay compensation from the builder.
In the given situation, if you take the possession of the said flat for which you filed a complaint in the concerned court, the case you are making will become quite weak, however you can still continue with the complaint of delayed possession. Thus, you should read the agreement carefully before taking the possession of the said flat.
