Car sold to the consumer fraudulently with hidden facts

Hi Sir, I bought a car in august 2017 from someone based on his statement that car is Dev 2006 model and run 1.35 lakh kms.. After buying I came to know that car is jam 2006 model and last service done at 1.36 lakh kms in October 2014. I lodged the complaint in Dwarka police station but after 2 months they refused to lodge fir as I did not take any written statement about odometer reading from the seller.. Where as I shown him the service record odometer reading report from the concern service center.. I just want to know that should I go with 156(3) to get the justice or my case is not able to get the fir registered through 156(3)..
As far as your query is concerned.. The FIR should b reg. by 156(3) proceeding and you can also file the case in the consumer court to refund your money and cost and damages .. you can call for further assistance
if you do not have the specifics of the car sold in writing and only a verbal false representation from the seller, your case is difficult to prove. in consumer law, the onus is on the consumer to be diligent. the doctrine of ' Buyers Beware' applies. however, we can discuss as to what were the terms of the purchase and accordingly take a call.

yes..you can very well do that if police guys are not registering your FIR.
Also, it would be advisable that before approaching Magistrate, you may also approach the Superintendent of Police of the district requesting him to direct an investigation under the provisions of Section 154(3) Cr.P.C
Nevertheless, without going to the SP you can go to the Magistrate under Section 156. It has been very recently settled by the Supreme Court that once the Magistrate directs the police to investigate, they will have to register the FIR first before they commence their investigation
