Car engine ceased in transit by packer & movers

My car engine has been ceased completely by renowned Packer & Movers company. Insurance claim was rejected and initially the Packer & Mover company said they will bear cost. However, upon knowing that engine replacement cost would be approx 3 lacs. They refused to pay for new engine and said will only bear cost for repair of present engine. The car was sent to renowned multi brand workshop for repair of engine and company paid advance amount. Now after several attempts of repair, the engine is not working and replacement of engine is only option to make car road worthy. The Packer & Mover comp

You should approach District Consumer Redressal Forum in your area and file your complaint. You will have to prove deficiency in service on behalf of the packers and movers. Hire an able counsel in your area who is equipped with consumer practice.

Problems and faults with items you buy can be major or minor and there are different issues for particular products. A major fault is one where the item does not work as it is supposed to.
If you start using the item for some time then it is deemed that you have accepted the item. But if you discover a fault then you are entitled to have the item repaired or replaced free of charge – provided you did not cause the damage.If it is impossible to repair the item, or if it is more convenient than repairing it, then the seller has to replace it for you.
Even if you take advantage of every repair option available, you may still file a civil lawsuit for damages. For instance, the exchange of engine will provide options for repair, replacement, or refund. But those remedies don't cover any injuries you may have sustained from an accident resulting from the faulty part.

The case can be filed against the packer and mover depending on the terms and conditions of the agreement you have entered into. Also it has to be seen how the movers have committed that they will be replacing the engine and other conditions of transfer. It is advisable to initiate a consumer case against the movers as the disposal of the case is quick and not many formalities are involved and you can be awarded compensation for litigation and other expenses. However, do obtain a report of an expert from the company or the manufacturer stating that the engine has to be replaced and there is no other alternative repair option available.
