Car breakdown due to turbo failure within 6 days of purchase

07-Apr-2023 (In Consumer Court Law)

I have bought a new car and went for a trip with family. while returning back to origin, car suddenly stopped on national highway and could not start. it has been dragged to nearest service station ( around 70kms ). they took 10 days to replace the failure part. by the time i have mentally depressed because this is my first car i bought in my life and this was happened with in short span of time. now every time i take this car out for travel, my mind is still saying in doubt this should not repeat again. they have replaced the parts under warranty only. can i file a case against manufacturer?

If you feel there is fault on the part of the manufacturer, you can definitely approach the consumer court. Is the car within warranty period???

Need to know your case in details for suggesting further.

Dear Querist,
Sorry to note that your dream (first) car has given you problem. Nothing prevents you from filing a consumer case for deficiency of services, mental agony and compensation, but remember that the manufacturer has serviced and replaced the part, so that will not amount to deficiency of services and your case will become weak. See if any other problem arises within the warranty period then certainly you have a case for deficiency of services.
