Cancelled my booking how can i recover the amount from builder

Hi sir, have a book a plot with Sri Durga Properties, Bangalore past 3-years back. I have paid 5Lac and I see that there is no development done by the developer and I placeda request for cancellation. The developer said he will pay back the money with a stipulated time(30 days)...but now whenever I call he either pushing the date (its been 6months) or giving all stupid reasons. I would like to recover my money and make sure that his kind of cheating will not happen with others so I want to expose these guys. I also see similar cases with the builder in consumer. Please guide how to proceed

This is becoming common, if the builder does not pay, you can issue a legal notice to refund the advance amount. However, u must also see the terms and conditions or agreement if any executed and see if there are any liquidated damages clause. After issuing the legal notice if he does not refund the money or does not respond u can file a consumer case for unfair trade practices, deficiency of services, mental agony and compensation.

The new law taking Stern action such builder is yet waited which has been passed by parlaiment , any how even now you can get your reimbursement and you can approach us hence nothing to worry much you can approach in right legal approach without complicating things .Ofc: panakj Kumar , advocate.

Dear Sir/Madam, you have good case on merit, you have to issued a legal notice to refund the advance amount which you have paid alongwith interest against the said Sri Durga Properites, Bangalore. If the said Durga properties failed to comply the demand legal notice thereafter you have to file petition before the District Consumer Forum to claim the refund amount alongwith interest as well as compensation for mental agony and etc.,.
