Cancelled my booking for flat how can I recover my amount

Hi, I bought an apartment from a reputed builder in Gurgaon in March 2003. I have paid regularly till January 2015 but I am no longer interested in pursuing this property. I have stopped making payments after that and now seeking a refund from the builder. I am fine with builder deducting the Earnest Money as per the agreement and refund the remaining amount but the builder does not entertain my request. They say its their prerogative to cancel an apartment not the buyer. They are continuously charging me interest @ 18% on all due invoices that were raised post Jan 2015; what shall I do?

You must immediately file a consumer complaint before the State consumer commission wherein you should ask for a full refund including the earnest money plus compensation. I suppose the project is delayed and that would make your complaint all the more forceful. This is the fastest and the most effective remedy for your situation.

The builder is not right in saying that you have no right to cancel the booking. Most of the builders brow beat the customers like that and hold on to their money illegally as long as they can For you there is no way out except to approach the consumer court, earlier the better.
