can the bank charge the EMIs for the loan which isn't even disbursed

Hi, I had transferred my home loan from one bank to another in March'16. The new bank offered me to take a top-up loan for home registry and renovation amounting to 12L. I opted for that top-up. Now, since the registry process is delayed from my builder for some paper work, the bank is not disbursing my top-up amount saying that they need complete paperwork, which includes registry in order to disburse that amount. In the mean time, they are regularly charging me the principal and interest in the forms of EMI at the top-up amount which is not even disbursed. I have already paid EMIs for last 11 months at Rs.16000 each month just for this top up loan amount (this does not include EMI for regular home loan). My question is can the bank charge the EMIs for the loan which isn't even disbursed? I feel tricked here. Bank is still charging me the EMIs and refusing to provide reversal. What are my legal measures in this case?

In this case I want to clear that there might b this kind of provision in bank rules but this is nothing but abuse of law. There are good grounds of registration of criminal cases on bank like 420,406 and all others. It's a good case on merits and really criminal mischief with u
