Can I file case against the Dealer for selling car with wrong info?

I bought a swift Desire from a private Dealer for 2,65,000/- he said the car is in perfect condition but i had to pay 20000 extra. and now when i m asking for the selling paper he is not giving it. the car papers are not in his name as well. now i am asking for refund then also i m getting no response. what action can be taken against the dealer
Do you have receipts of the payment made to the seller or any contract was made between you two?
If yes, then you can send him a legal notice thorugh an advocate asking for the refund of the payment within a stipulated time, failing to do so you can file a case in the consumer court against the dealer.
