can I file a case against a company for a second hand car

10-Jul-2023 (In Consumer Court Law)
My Nissan Micra Diesel car (2nd hand purchased - 2013 Model) while driving got struck in a stone in the bottom and engine oil drained and engine ceased in 5 kms of driving, as we couldn't see the oil leak. Now for repair they are asking Rs. 1.7 L (Car worth itself only 2 L) My question is when they could identify the oil leak and initiate a red light alarm in the display, why can't theu switch off the engine before it get ceased. They may ask defend that, the sudden stop of engine mayead to accident!!! Again my question is, however the engine going to stop in another 2 to 3min based on leak intensity, so before that they could slow down and stop, so that we could safe guard the engine and the expenses will only be around Rs. 10 to 30k only to correct the engine oil leak. In this point may we represent it in the consumer court. (Insurer not covering this engine cease, as they cover only first accident that is engine oil sump leak, engine cease because of first accident didn't cover)

Hello Sir,
Given the Manufacturing year, your vehicle would be beyond Warranty Period. So as of now, Company can't be held liable given that a stone has caused the whole accident. I don't think you can seek any remedy from consumer court.

the entire writing is confused one, the person has not mentioned the correct fact of the case for which he seeks remedy. though it may come under consumer protection first a notice to be sent and after that only it can be proceeded.
