Can builder demand GST on the amount which is due of the flat

I purchased an under construction flat in Dec'15 which was 90% complete at the time of purchase. I paid the same amount through home loan and cleared all the dues within a month along with service tax for full amount. The flat was supposed to be ready by Dec 16 as per sales commitment and by June 17 as per agreement. At that time, there was no GST. Now my builder is asking me to pay GST on last 10% of the amount excluding the service tax on 10% amount which I had already paid in the beginning. As builder was not able to finish the construction on time, does he have any right to take GST from me ?
Considering provisions of Goods and service tax, GST is applicable to the commercial properties which completion certificate is not obtained from concern municiple corporation.....so GST is applicable in your case....however you can claim you loss caused by the builders negligence before consumer court....
