Can an advocate who take district forum cases can take state cases

26-Mar-2023 (In Consumer Court Law)

Can a non advocate person represent a consumer or the defendant in the district forum and the state commission by charging fees from him ? Is there a rule or precedent that only advocates can charge fees and appear ? Is it barred by any provision of the Advocates Act ? Please give relevant citation, if any, supporting your answer. Thanks in advance.

As per your query, the consumer himself or any person he wishes can represent his case in the consumer forum. No, it is not barred by any provisions of the advocates act.  The Courts have granted a party to the proceeding before the District Forum/State Commission the right to authorise a person of his choice to represent him and also to examine and cross-examine the witnesses, address the Court and take part in the proceedings as the case may be.
