Builders is not giving possession over my flat

I have booked a flat by paying its booking amount for Rs.5,00,000/- to the builders. An agreement was executed between us stating there in that delivery of possession will be given by the builders within 24 months from the date of booking. I have been making regularly prescribed installments and yet the construction is not completed even after 4 years from date of booking. need legal advise.
This is common with real estate developers these days. We can help you with a legal notice and then based on their response you can either go for a settlement or file a consumer complaint for deficiency in service. The court with help you to recover your deposits and also allow you some interest on the same and if you are lucky you will awarded some compensation for mental agony.

Your case against the builder is quite common unless u choose a good and honest builder. Since an agreement has already been executed that within 24 months the possession will be delivered, u can first of all issue a legal notice questioning the delay and the fact that u r moving for consumer court for deficiency of services and unfair trade practices, based on the reply or no reply, u can move the consumer court for compensation and mental agony, your problem should be solved.

Dear Sir/Madam, you have every right to get your hard money invested flat with in time, you can claim compensation for delay possession from your builder by issuing a legal notice and if they have failed to do the same, you have to approach consumer forum for the same...
