Builder sold flat to two people case pending what can be done

SIR MY BUILDER HAS SOLD FLAT TO ME , WHICH WAS ALREADY SOLD TO OTHER, YEAR BACK. THAT OWNER IS PAYING EMI AND I AM ALSO PAYING EMS TO MY BANK. THERE ALSO SOME OTHER CASES IN SOCIETY. THERE IS A COMMON FIR AGAINST THAT BUILDER. THE CRM CASE IS PENDING IN HIGH COURT OF PUNJAB AND HARYANA. CAN I CLAIM FOR STAY FOR MY FLAT IN MY FAVOUR

You can prove the misdeed of the builder and claim your flat/unit in the same tower or the money along with interest through the consumer court or through permanent Lok Adalat as well. A FIR is also maintainable against the said misdeed.

Certainly there is a concern of you with the flat you booked, but as far as your query regarding stay of your booked flat is concerned, same can be advised only after checking the records and pending cases against the builder of the society, however, since you are party to agreement to sell of said flat, and if you are apprehended about builder further entering into compromise, you can avail the remedy of injunction against the builder/ society/ individual/ owner, and you have criminal remedy also.
