Builder refusing to pay pre emi as promised, what can be done?

Have borrow a home loan as per agreement builder have to pay pre emi till possession but now builder refuse it bank harrash me as they said we gave loan on your basis not to builder so what we do? kindly help me

Serve a legal notice to him.
Get in touch with fellow buyers and act strongly .
Also it is desirable to file a consumer complaint at the district forum for speedy action. There are precedents as well In support

Hi, ,Need some more details about the case ( builder made a default on giving possession), on the basis of given facts you can go to consumer court against the builder and give the application to request the bank for postponing the payments of installments till the decision of the court.

You need to look into the terms and conditions flat buyers agreement. If under the obligation the builder was obligated to pay pre-EMI till possession then you can take legal action against the builder for non-compliance. You must give a written representation to a builder for same, which will be followed by a legal notice by your lawyer. In a case of no response from Builder to your legal notice, you are well within your rights to take your Builder to Court i.e. Consumer Forum.
