Builder not ready to refund full payment made towards booking property

I am Hindu from Gujarati family. Invested Rs. 16.28 lacs in under construction property in 2010. But the builder has still not constructed the building and now existed from the project. The allotment letter says if the work not done within 2 years, the money will be refunded with 24% interest p.a. The new builder is promised to refund the money with additional amount of Rs. 6 lacs only. What to do ?
You can file a suit for breach of contract in your nearest civil court or if the new builder is giving assurance make an agreement with the new builder regarding the same if new builder denies for agreement then sue the old builder in the court.Please contact your local lawyer for further advice.
