Builder not providing amenities as issued by LPA

In Coimbatore District, Chinnavedampatty village we have constructed 383 individual houses which was constructed by a leading Promoter. They denied to complete the basic amenities as per conditions issued by the Local Planning Authority .What kind of legal action can we taken (Association) to get remedy.

File complaint against builder in district consumer forum, what is his version, why he is not keeping up word? it will take to get any remedy from the above said forum, so it is better to have alternate dispute resolution in place and try to get things done.

Hi,

The given facts didn't say anything about the terms and conditions between you and the construction company or is there any contract between you and the company. if the construction company accepted to complete the said amenities in the contract and if they breached the terms then you can approach the civil court with a suit for specific performance and moreover if the agreement contains arbitration clause then you can invoke the same. Also, you can approach the consumer forum/commission with a complaint against the construction company for deficiency of service and seek damages for the same only if there is no commercial interest involved (from your side) so that you can fit into definition of 'Consumer' as per the act.
