Builder not following the court orders what should I do

Hi, I recently won a consumer case against a Developer in Bangalore and he was sent a court notice to refund the amt due to me with 15k compensation. But the OP is not abiding by the court order. He is adamant and has no sign to abide by the court order. What legal action I can take against him. Please advice. Thanks, Srividya

Dear Madam, you have to execute the said court order by way of filing execution petition in the same court and take attachment movable and immovable properties of the said developer offices immediately, it is the only legal way to recover the decreetal/compensation amount alongwith your refund of your amount from the said developer.

You have obtained an award from the consumer court, you are lucky to get a compensation of 15 thousand, you can take a hand summons on the builder and try to serve him, even otherwise you can file a application for arrest, once you obtain warrant of arrest he will abide by the court order.

When you have got court order you need not to worry.
File an execution petition in the consumer court it self. First notice will be issued, if he remained absent in spite of receipt of the court notice then you can make a submission to the court to issue Non bailable warrant.
