Builder not doing construction and TPP expired

HI , I booked a Flat under subvention scheme in June 2013 and the Flat was suppose to be build and handover in Dec 2015. Till now nothing have been done on the construction part from BPTP end and also the Third Party agreement for Subvention scheme also got expired in Nov 2016 ( after extending for one month) . Later it was decided by BPTP that we should keep paying the EMI to bank and BPTP will be depositing the same amount in our account but till now I've paid almost 10 installments but BPTP is not paying me back and always replying stating that they are streamlining the process.I've no idea , Is I am really bound to make that payment or else what should be the next step for me to safe my self from loosing my credibility with bank and my financial losses by BPTP not returning my already paid EMI amount. Could you please guide me on the same.
As you are consumer of BPTP, you can file a complaint in consumer forum against them for their unfair trade restrictive practices and deficient service, seeking the refund of your amount paid to them alongwith interest of that amount and compensation for your harassment.

If you have tried to all the option to talk with them (BPTP) and they are still reflecting dilly dally nature towards your concerns, then only one option left with you is LITIGATION. you can go in the District Consumer Forum with a complaint( In written) against the builder and raise all you concerns before the forum. After that , if your all the the issues looks genuine, then consumer court will definitely grant you relief.

I advice you to file case in consumer court.i have handled many similar cases.you will definitely get relief from consumer court alog with compensation for harassment from builer.now a days consumer court are strict towards unfairs practices from builders.
Hi, You can file a complaint before a jurisdictional consumer forum (depending upon the value of property and compensation amounts sought). Alternate remedy is to file your complaint before the State RERA Authority.
