Builder made extra construction due to which PCMC denied CC

I have purchase property in Pune, and builder given possession to me and I am staying there. total 18 flats in building which are fully occupied. I got possession in march 2013 , but our building not received completion certificate as builder has done some extra construction about 5% of approve FSI, for which he claim that when he started construction it was legal to build up to 10% extra construction and now after completion of building this rule is removed by ex PCMC commissioner ( Pardeshi) . Now PCMC (Pimpri Chinchwad Municipal Corp.) denied to give CC due to extra construction.
