Builder is not returning the amount what action can I take?

dear sir 1. I had carriedout an online fund transfer of rs one lakhs as a booking amount for a under construction flat in banglore in dec 2015. 2. Due to some other financial committment in my family I could not go ahead in buying the flat. 3. I have not got any aggrement nor reciept of the amount paid as booking amount of rs one lakh 4. I have asked the developer to return the money but he is refusing and neither he is giving the reciept of the booking amount. 5. The project is almost complete 6 Can u please suggest my next course of action for getting the money regards sharad
The builder cant hold your money outside agreed terms and conditions and in which case you can demand refund. The first step would be to send a legal notice now and after that you may also file a complaint in District Forum (Consumer court).
