Builder delayed possession want my booking amount back

I am a retired govt employee 79 yrs old after retirement all my benefits money investate to buy a shelter home with a builder Bptp Faridabad Haryana in the yr 2009 June more than 7 yrs have passed since builder not giving possession of the house till date the construction work held up from 2011 june,builder supposed to hand over the house within 30 month's of builder buyers agreement which was held 27th October 2010,I have supposed to get the possession of the house April 2013,several correspond done with builders but not get any definite information,when they are hand over the house.in this old age I have invested my life time hard earned money to getting a dream home &stay with my family,but now I feel my dream Will never be fulfilled in my life time.last few years I had run pillar to post to get my home but all are in vain. Dear Sir,
In view of the facts and circumstances narrated in your question, you have following options:-
1. You may file file a consumer case seeking possession and alternatively, refund with interest amount;
2. You may file a civil suit for damages;
3. You may also choose to file a criminal complaint against the builder for cheating and particularly breach of trust;
However, the right remedy considering your age is to knock the doors of the consumer forum/commission depending on pecuniary and territorial jurisdiction and seek possession of the flat and alternatively refund with interest what is/was being charged by the Builder.
Of late, Consumer Forums/Commission has been passing adverse against the builders for having indulged in unfair trade practices.
From the facts, you have good case on merits.
